- Webseiten-Hosting (Frontend): Vercel Inc., USA.
Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO (Vertrag bzw.
10. Kontaktaufnahme
- Löschung Ihrer Daten (Art. 17 DSGVO), soweit keine gesetzlichen Aufbewahrungspflichten entgegenstehen

1. Overview of processing purposes
Safety Car buys inspected used vehicles from private sellers and resells them to registered commercial car dealers. We process personal data for the following purposes:
- Purchase and resale of vehicles (initiation, inspection, performance of contracts)
- Operation of this website and the auction platform, including dealer accounts
- Payment via an escrow service, transport and handover
- Security of the platform and protection against misuse
- Compliance with legal obligations, in particular retention obligations under tax and commercial law
We have not appointed a data protection officer, as the legal requirements for doing so (Art. 37 GDPR, Section 38 German Federal Data Protection Act – BDSG) are not met. For any data protection questions, please use the contact details above.
2. Website access, hosting and security
2.1 Server log files
When you access our website and the auction platform, our hosting providers automatically process technical access data: IP address, date and time, requested page or interface, status code, amount of data transferred, referrer URL and browser and operating system information (user agent). This is necessary to deliver the pages, detect faults and ensure security.
The legal basis is our legitimate interest in stable and secure operation (Art. 6(1)(f) GDPR). Server log files are deleted automatically after seven days at the latest.
2.2 Security log of the auction platform
To protect against misuse, manipulation of auctions and unauthorised access, we log security-relevant actions in dealer accounts, such as registration, login and bidding. We store the user ID, the type of action, the time, the IP address and the user agent. For each bid, we additionally store a shortened, irreversible hash of the IP address in order to detect multiple or fake bids.
The legal basis is our legitimate interest in a fair auction process that cannot be manipulated (Art. 6(1)(f) GDPR). Entries in the security log are deleted after 90 days unless they are needed to investigate a specific incident. The hash for a bid is stored together with the bid data (see section 13).
3. Service providers and transfers to the USA
We use carefully selected service providers that process personal data on our behalf and strictly on our instructions (Art. 28 GDPR). We have concluded data processing agreements with these providers.
- Database, user accounts and file storage: Supabase, Inc., USA. This stores dealers' account and registration data, bid data, the security log and vehicle documents. Data is hosted in a data centre in the European Union (Ireland).
- Server and application hosting (backend): Railway Corporation, USA.
- Website hosting (frontend): Vercel Inc., USA.
- Email delivery: Resend, Inc., USA, for the automatic emails described in section 7.
Railway, Vercel and Resend process data in the USA. With Supabase, access from the USA, e.g. for maintenance and support, cannot be ruled out. For the USA, there is an adequacy decision of the European Commission (EU-US Data Privacy Framework). Where a provider is certified under it, the transfer is based on Art. 45 GDPR. Otherwise, we have agreed the EU Standard Contractual Clauses with the providers (Art. 46(2)(c) GDPR). The legal basis for using these providers is the performance of a contract (Art. 6(1)(b) GDPR) and our legitimate interest in secure and reliable operation (Art. 6(1)(f) GDPR).
Program library via jsDelivr
The auction platform loads a program library via the content delivery network jsDelivr (operated by Prospect One and its network partners Cloudflare and Fastly). In the process, your IP address is transmitted to these providers; processing in the USA is possible. The legal basis is our legitimate interest in providing the application reliably and quickly (Art. 6(1)(f) GDPR). Where data is transferred to the USA, the transfer is based on the EU-US Data Privacy Framework or on the EU Standard Contractual Clauses.
4. Vehicle purchase (sellers)
When we buy a vehicle, we process the seller's data: name, address, telephone number and email address, vehicle and condition data including the inspection report, bank details for payment of the purchase price, and the contract documents. We receive this data directly from the seller. Where we approach a seller about a publicly advertised vehicle, the vehicle and contact details come from the respective advertisement.
The legal basis is the performance of the contract or pre-contractual measures (Art. 6(1)(b) GDPR) and, for retaining business records, compliance with legal obligations (Art. 6(1)(c) GDPR). Approaching a seller about a public advertisement is based on our legitimate interest in purchasing vehicles (Art. 6(1)(f) GDPR).
4.1 Identity document and registration certificate
To verify identity and ownership, we process a copy of the identity document and of the registration certificate Part II (vehicle title). We only make a copy of a German identity card with the holder's consent (Section 20(2) German Identity Card Act – PAuswG). The copy is identifiable as such; you may black out information that is not needed, such as the access number, height or eye colour. The transfer is encrypted. We delete the copy of the identity document once the transaction has been completed, unless a statutory retention obligation applies.
Legal basis: Art. 6(1)(b) GDPR (contract or initiation of a contract) and our legitimate interest in preventing fraud and the purchase of stolen vehicles (Art. 6(1)(f) GDPR).
5. Safety Car-Check
As part of the Safety Car-Check, an automotive mechatronics technician inspects the vehicle on site. This produces an inspection report and photographs documenting the vehicle's condition. We process in particular vehicle data, technical findings, the vehicle identification number and the photographs.
Vehicle photos are taken in such a way that, as far as possible, no persons or personal features of third parties are captured. The licence plate is made unrecognisable for the auction. The photos serve exclusively to document the condition of the vehicle.
The legal basis is the performance of the contract or pre-contractual measures (Art. 6(1)(b) GDPR). The inspection report forms the basis for the subsequent dealer auction.
6. Auction platform and dealer accounts
During registration, we process the company name, the name of the contact person, email address, telephone number, the selected language and the password, which is stored only in encrypted (hashed) form. Before approving a dealer account, we may request further evidence, in particular a trade registration or register extract, address and VAT identification number. During ongoing use, we process account data, bids, purchases and communications with the dealer.
The legal basis is the initiation and performance of the contractual relationship (Art. 6(1)(b) GDPR) and our legitimate interest in a verified, trustworthy dealer network (Art. 6(1)(f) GDPR). We have the VAT identification number confirmed by the German Federal Central Tax Office (Bundeszentralamt für Steuern) where this is necessary for VAT purposes (Art. 6(1)(c) GDPR).
During the auction, participating dealers only receive vehicle-related information – inspection report, vehicle data and photographs. The seller's personal data is not disclosed during the auction. Bids are displayed anonymously to other dealers.
7. Automatic emails
We send registered dealers automatic emails that are part of using the platform: registration confirmation, account approval, notification of being outbid, notification of the highest bid at the end of an auction, notifications of new auctions and of an auction ending soon, and password reset emails. The emails are sent via Resend in the language selected during registration.
The legal basis is the performance of the user agreement (Art. 6(1)(b) GDPR). You can unsubscribe from notifications of new auctions and auctions ending soon at any time by sending a short message to kontakt@safetycar.net.
8. Escrow payment
Payment of the purchase price is processed via the escrow service Paylax. For this purpose, we transmit the data required for processing – in particular name or company name, contact details, contract and payment data – to Paylax. The legal basis is the performance of the contract (Art. 6(1)(b) GDPR).
Where Paylax collects data for its own purposes, in particular to comply with statutory verification and identification obligations, it processes this data as an independent controller; in this respect, the Paylax privacy policy also applies. In addition, we transmit payment data to the banks involved where this is necessary for processing.
9. Transport, handover and recipients
Once a purchase contract with a dealer has been concluded, we pass on the data required for collection to the purchasing dealer and to the transport provider commissioned by the dealer or by us, in particular the pick-up address, the seller's name and telephone number and vehicle data. The purchasing dealer may be established in another member state of the European Union, in particular in Poland. No transfer to countries outside the EU or EEA takes place in this context.
The vehicle documents, in particular the registration certificate Part II, contain information about the previous keeper. They are handed over to the purchasing dealer together with the vehicle, as they are essential for registration and resale. Dealers are contractually obliged to use this data exclusively for the collection, registration and resale of the vehicle.
The legal basis is the performance of the purchase contract with the seller, which includes the resale of the vehicle (Art. 6(1)(b) GDPR), and our legitimate interest in completing the resale (Art. 6(1)(f) GDPR).
Categories of recipients overall: escrow service, banks, transport providers, purchasing dealers, IT and hosting providers (section 3), tax advisors and public authorities within the scope of legal obligations.
10. Contacting us
If you contact us by email or telephone, we process your details to handle your enquiry. The legal basis is the performance of pre-contractual measures (Art. 6(1)(b) GDPR) or our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). We delete the data once the enquiry has been dealt with, unless statutory retention obligations apply (see section 13).
11. Cookies and local storage
The auction platform uses only technically necessary storage in your browser's local storage:
- Login session (Supabase) – keeps you logged in; removed when you log out.
- Language setting – stores the selected display language.
- Privacy notice – stores that you have acknowledged the privacy notice.
This storage is strictly necessary for the use of the platform that you have expressly requested and therefore does not require consent (Section 25(2) No. 2 German Telecommunications Digital Services Data Protection Act – TDDDG). Subsequent processing is based on Art. 6(1)(b) GDPR. We do not use tracking, analytics or advertising cookies. You can delete the local storage at any time via your browser settings.
12. Fonts
The fonts used are hosted locally on our server. No connection to third-party servers (in particular Google) is established for this purpose when you access our pages.
13. Storage period and deletion
We store personal data only for as long as necessary for the stated purposes or as required by statutory retention obligations. The data is then deleted. In detail:
- Server log files: seven days at most.
- Security log: 90 days, unless a specific incident occurs.
- Copies of identity documents: deleted once the transaction has been completed.
- Dealer account: until the account is deleted; bids and purchases beyond that until the limitation periods for contractual claims have expired (generally three years from the end of the year of the auction).
- Accounting records (e.g. invoices, purchase contracts as accounting records): eight years (Section 147(1) No. 4, (3) German Fiscal Code – AO; Section 257(1) No. 4, (4) German Commercial Code – HGB).
- Commercial and business letters and other documents relevant for tax purposes: six years.
- Books, inventories and annual financial statements: ten years.
Retention periods begin at the end of the calendar year in which the document was created.
14. Obligation to provide data, no automated decisions
Providing the data marked as required is necessary for concluding and performing the contracts and for using the platform. Without this data, we cannot carry out the purchase, the registration or the sale. There is no statutory obligation to provide the data unless statutory identification or verification obligations apply.
No decision-making based solely on automated processing, including profiling, within the meaning of Art. 22 GDPR takes place. Decisions on approving dealer accounts and accepting bids are made by us personally.
15. Your rights
As a data subject, you have the following rights:
- Access to information about the processing of your personal data (Art. 15 GDPR)
- Rectification of inaccurate or incomplete data (Art. 16 GDPR)
- Erasure of your data (Art. 17 GDPR), unless statutory retention obligations apply
- Restriction of processing (Art. 18 GDPR)
- Data portability in a structured, commonly used and machine-readable format (Art. 20 GDPR)
- Withdrawal of consent given, with effect for the future (Art. 7(3) GDPR)
- Complaint to a data protection supervisory authority (Art. 77 GDPR)
Right to object under Art. 21 GDPR: Where we process your data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you have the right to object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. You may object at any time, without giving reasons, to the use of your email address for notifications of new auctions.

- wypełnianie obowiązków prawnych, w szczególności obowiązków przechowywania wynikających z prawa podatkowego i handlowego.
37 RODO, § 38 niemieckiej federalnej ustawy o ochronie danych – BDSG). W sprawach dotyczących ochrony danych prosimy o kontakt pod wskazanymi powyżej danymi.
2. Korzystanie ze strony, hosting i bezpieczeństwo
2.1 Logi serwera
Podczas korzystania z naszej strony internetowej i platformy aukcyjnej nasi dostawcy hostingu automatycznie przetwarzają techniczne dane dostępowe: adres IP, datę i godzinę, żądaną stronę lub interfejs, kod statusu, ilość przesłanych danych, adres URL strony odsyłającej oraz informacje o przeglądarce i systemie operacyjnym (user agent). Jest to niezbędne do wyświetlania stron, wykrywania usterek i zapewnienia bezpieczeństwa.
Podstawą prawną jest nasz prawnie uzasadniony interes w stabilnym i bezpiecznym działaniu (art. 6 ust. 1 lit. f RODO).
3. Usługodawcy i przekazywanie danych do USA
28 RODO). Z tymi dostawcami zawarliśmy umowy powierzenia przetwarzania danych.
- Baza danych, konta użytkowników i przechowywanie plików: Supabase, Inc., USA. Przechowywane są tu dane kont i rejestracji dealerów, dane ofert, dziennik bezpieczeństwa oraz dokumenty pojazdów. Dane są przechowywane w centrum danych w Unii Europejskiej (Irlandia).
- Hosting serwera i aplikacji (backend): Railway Corporation, USA.
- Hosting strony internetowej (frontend): Vercel Inc., USA.
- Wysyłka e-maili: Resend, Inc., USA – automatyczne wiadomości opisane w punkcie 7.
W przypadku Railway, Vercel i Resend dane są przetwarzane w USA. W przypadku Supabase nie można wykluczyć dostępu z USA, np. w ramach konserwacji i wsparcia technicznego. Dla USA obowiązuje decyzja Komisji Europejskiej stwierdzająca odpowiedni stopień ochrony (EU-US Data Privacy Framework).
6 ust. 1 lit. b RODO), a w zakresie przechowywania dokumentacji handlowej – wypełnienie obowiązku prawnego (art. 6 ust. 1 lit. c RODO). Kontakt w sprawie publicznego ogłoszenia następuje na podstawie naszego prawnie uzasadnionego interesu w zakupie pojazdów (art. 6 ust. 1 lit. f RODO).
4.1 Dokument tożsamości i dowód rejestracyjny
6 ust. 1 lit. b RODO). Protokół kontroli stanowi podstawę późniejszej aukcji dla dealerów.
6. Platforma aukcyjna i konta dealerów
6 ust. 1 lit. b RODO) oraz nasz prawnie uzasadniony interes w posiadaniu zweryfikowanej i wiarygodnej sieci dealerów (art. 6 ust. 1 lit. f RODO). 6 ust. 1 lit. c RODO).
W trakcie aukcji uczestniczący dealerzy otrzymują wyłącznie informacje dotyczące pojazdu – protokół kontroli, dane pojazdu i zdjęcia.
9. Transport, wydanie pojazdu i odbiorcy
6 ust. 1 lit. b RODO), oraz nasz prawnie uzasadniony interes w realizacji dalszej sprzedaży (art. 6 ust. 1 lit. f RODO).
Kategorie odbiorców łącznie: usługa rachunku powierniczego, banki, przewoźnicy, kupujący dealerzy, dostawcy usług IT i hostingu (punkt 3), doradcy podatkowi oraz organy państwowe w ramach obowiązków prawnych.
10. Kontakt z nami
11. Pliki cookie i pamięć lokalna
13. Okres przechowywania i usuwanie
- Logi serwera: maksymalnie siedem dni.
- Dziennik bezpieczeństwa: 90 dni, chyba że wystąpi konkretny incydent.
- Kopie dokumentów tożsamości: usunięcie po zakończeniu transakcji.
- Konto dealera: do czasu usunięcia konta; oferty i zakupy ponadto do upływu terminów przedawnienia roszczeń umownych (co do zasady trzy lata od końca roku, w którym odbyła się aukcja).
- Dowody księgowe (np. faktury, umowy sprzedaży jako dowody księgowe): osiem lat (§ 147 ust. 1 pkt 4, ust. 3 niemieckiej ordynacji podatkowej – AO; § 257 ust. 1 pkt 4, ust. 4 niemieckiego kodeksu handlowego – HGB).
- Korespondencja handlowa i inne dokumenty istotne podatkowo: sześć lat.
- Księgi, inwentarze i sprawozdania finansowe: dziesięć lat.
Okresy przechowywania rozpoczynają się z końcem roku kalendarzowego, w którym dokument powstał.
22 RODO. O zatwierdzeniu kont dealerów i przyjęciu ofert decydujemy osobiście.
15. Twoje prawa
Jako osobie, której dane dotyczą, przysługują Ci następujące prawa:
- dostęp do informacji o przetwarzaniu Twoich danych osobowych (art. 15 RODO),
- sprostowanie nieprawidłowych lub niekompletnych danych (art. 16 RODO),
7 ust. 3 RODO),
- wniesienie skargi do organu nadzorczego ds. ochrony danych (art. 77 RODO).
Prawo sprzeciwu na podstawie art. 21 RODO: Jeżeli przetwarzamy Twoje dane na podstawie prawnie uzasadnionych interesów (art. 6 ust. Wobec wykorzystywania Twojego adresu e-mail do powiadomień o nowych aukcjach możesz w każdej chwili wnieść sprzeciw bez podania przyczyny.
